1. Overview

Welcome to Layer Supply.

Layer Supply is operated by Tillema Extended Media, trading under the registered trade name Arista Ecom.

In these Terms of Service, the terms “Layer Supply,” “we,” “us” and “our” refer to Tillema Extended Media, trading under Arista Ecom.

We operate the Layer Supply website and online store, including all related information, content, features, tools, digital products and services. Together, these are referred to as the “Services.”

Our online store is powered by Shopify, which provides the e-commerce infrastructure that enables us to offer the Services to you.

These Terms of Service, together with any policies and agreements referenced in them, describe the terms that apply when you access our website, purchase our products or otherwise use our Services.

By accessing or using the Services, you agree to these Terms of Service and our:

  • Privacy Policy;
  • Return and Refund Policy;
  • Digital Delivery Policy;
  • Commercial License Agreement;
  • Cookie Policy, where applicable.

If you do not agree to these Terms, you must not access or use the Services.

Nothing in these Terms limits any mandatory rights you may have under applicable consumer law.

3. Eligibility and use of the Services

By using the Services, you confirm that:

  • you are legally capable of entering into a binding agreement;
  • you are at least the age of majority in your country of residence, or have permission from a parent or legal guardian;
  • the information you provide is accurate, current and complete;
  • you will use the Services only for lawful purposes.

You may not use our Services or products in violation of applicable law or the rights of Layer Supply or any third party.

4. Accounts and customer information

You may be required to provide information such as your name, email address, billing address and payment information when placing an order or creating an account.

You are responsible for ensuring that the information you provide is correct and up to date.

You are also responsible for:

  • maintaining the confidentiality of your account details;
  • preventing unauthorized access to your account;
  • all activity conducted through your account;
  • informing us promptly if you suspect unauthorized access.

Accounts and download access may not be sold, transferred, shared or assigned to another person unless we expressly permit this in writing.

We may suspend or restrict an account where we reasonably suspect fraud, unauthorized sharing, license violations, chargeback abuse or another breach of these Terms.

5. Digital products

Layer Supply sells digital products only. No physical products are shipped.

Our products may include:

  • video assets;
  • overlays;
  • visual effects;
  • motion design assets;
  • editing resources;
  • presets;
  • templates;
  • sound effects;
  • project files;
  • digital tools;
  • downloadable bundles;
  • other digital creative resources.

The exact files, formats, specifications, compatibility information and included content are described on the relevant product page.

Customers are responsible for reviewing this information before purchasing.

Product previews, examples and promotional visuals may demonstrate possible uses of a product. Unless expressly stated otherwise, additional footage, music, fonts, software, mockups, plugins or third-party assets shown in a preview are not included.

6. Software and technical requirements

Some products require specific software, software versions, plugins, codecs, hardware or technical knowledge.

You are responsible for confirming before purchase that:

  • you own or have access to the required software;
  • your software version is supported;
  • your device meets any relevant technical requirements;
  • the supplied file formats are suitable for your intended workflow;
  • you have the knowledge required to use the product.

A product is not considered defective solely because it is incompatible with software, hardware or workflows that were not expressly listed as supported.

When we expressly advertise compatibility with specific software or file formats, the product should materially function as described with those supported systems.

7. Product information and previews

We make reasonable efforts to ensure that product descriptions, previews, specifications and compatibility information are accurate.

However, minor differences may occur due to:

  • display settings;
  • software interpretation;
  • compression;
  • color management;
  • operating systems;
  • third-party applications;
  • updates to supported software;
  • differences between preview media and source files.

These minor differences do not automatically mean that a product is defective.

We may update product descriptions, previews, included files and technical information where reasonably necessary. Such changes do not reduce statutory rights relating to purchases already made.

8. Orders

Placing an order constitutes an offer to purchase the selected product under these Terms.

An order is accepted once:

  • your payment has been successfully processed; and
  • we provide an order confirmation or access to the purchased product.

We may refuse or cancel an order where reasonably necessary, including in cases involving:

  • suspected fraud;
  • unauthorized payment use;
  • incorrect pricing caused by an obvious error;
  • technical errors;
  • abuse of discounts or promotions;
  • attempted resale or redistribution;
  • previous serious violations of our Terms or license conditions.

When we cancel an order after payment has been collected, the relevant amount will be refunded unless withholding the payment is permitted by law.

Please review your order carefully before completing your purchase. Due to the immediate delivery of digital content, it may not be possible to change or cancel an order after delivery has begun.

9. Prices, taxes and payment

Product prices are displayed in the currency shown in the online store.

Unless stated otherwise during checkout, prices displayed to consumers include any VAT or other taxes that we are legally required to include.

The final price, including applicable tax, discounts and any other charges, will be shown before you complete your purchase.

Prices, bundles, discounts and promotions may change at any time. Changes do not apply retroactively to completed purchases.

A later price reduction or promotion does not entitle customers who purchased earlier to a partial refund or price adjustment.

You agree to provide accurate and complete payment information and confirm that you are authorized to use the chosen payment method.

Payments may be processed by Shopify Payments or other third-party payment providers. Their own terms and privacy policies may also apply.

10. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions stated at the time of the offer.

Unless expressly stated otherwise:

  • discount codes cannot be combined;
  • discounts cannot be applied retroactively;
  • discounts have no cash value;
  • promotional offers may be withdrawn or changed before an order is completed;
  • misuse of a discount may result in cancellation of the affected order.

Automatic bundle discounts are calculated according to the conditions displayed in the store at the time of purchase.

11. Digital delivery

Digital products are normally made available shortly after successful payment through:

  • a download link on the order confirmation page;
  • an email containing download instructions;
  • a customer account;
  • another digital delivery method specified during checkout.

No physical shipment will take place.

Delivery may occasionally be delayed due to:

  • payment verification;
  • fraud screening;
  • technical maintenance;
  • incorrect customer information;
  • email delivery issues;
  • circumstances outside our reasonable control.

Customers are responsible for providing a valid email address and checking their spam or junk folder.

When you do not receive access to your purchase, contact us at contact@layersupply.store with your order number and the email address used for the order.

12. Right of withdrawal for digital content

Consumers in the European Union and European Economic Area generally have a 14-day right of withdrawal for distance purchases.

For digital content that is not supplied on a physical medium, this right may end once delivery begins where the consumer has:

  1. expressly consented to delivery beginning during the withdrawal period; and
  2. acknowledged that this causes the right of withdrawal to be lost.

When you provide this consent and acknowledgement and we make the digital product available to you, you can no longer cancel the purchase solely because you changed your mind.

This does not affect your legal rights when digital content:

  • was not supplied;
  • is defective;
  • materially differs from its description;
  • does not provide functionality or compatibility that was expressly promised.

13. Defective or non-conforming digital content

Digital products must materially correspond with their description and expressly stated functionality, file format and compatibility.

When a product is defective or does not materially conform to the purchase agreement, please contact us and provide sufficient information to investigate the issue.

Depending on the circumstances and applicable law, we may:

  • restore download access;
  • provide a corrected file;
  • replace missing or corrupted files;
  • provide technical assistance;
  • provide another appropriate remedy;
  • reduce the purchase price;
  • issue a refund.

Where appropriate, we will first be given a reasonable opportunity to bring the product into conformity unless immediate termination or another remedy is required by law.

European rules governing digital content provide consumers with remedies where digital content is not delivered or does not conform to the agreement.

14. License to use purchased products

Purchasing a Layer Supply product does not transfer ownership of the product or its underlying intellectual property.

Instead, you receive a limited license to use the product in accordance with:

  • the license displayed on the product page;
  • our Commercial License Agreement;
  • any product-specific license terms;
  • these Terms of Service.

Unless expressly stated otherwise, the license is:

  • non-exclusive;
  • non-transferable;
  • non-sublicensable;
  • subject to the restrictions described in the applicable license agreement.

Where these Terms conflict with specific license terms shown on a product page or in a separate license agreement, the more specific license terms apply to the use of that product.

15. Permitted commercial use

Subject to the applicable Commercial License Agreement, purchased assets may generally be incorporated into completed creative work such as:

  • video productions;
  • client projects;
  • advertisements;
  • films;
  • social media content;
  • motion graphics;
  • branded content;
  • online content;
  • other finished audiovisual productions.

The asset must be incorporated into a larger finished project and may not be provided to third parties as a standalone file, editable resource or reusable asset.

Any rights not expressly granted remain reserved by Layer Supply and its licensors.

16. Prohibited product use

Unless we expressly authorize it in writing, you may not:

  • resell or redistribute a product in its original or modified form;
  • share download links or source files;
  • upload products to file-sharing platforms;
  • include products in another asset pack, library or downloadable collection;
  • sublicense products;
  • make products available as standalone stock assets;
  • claim ownership or authorship of the underlying asset;
  • register a product or substantially unchanged version as a trademark;
  • use products to create directly competing downloadable products;
  • remove ownership notices embedded in product files;
  • use products in violation of applicable law;
  • use products for unlawful, fraudulent, defamatory or infringing purposes;
  • use products to train artificial-intelligence models or build datasets unless expressly permitted;
  • use automated systems to extract, scrape, catalogue or reproduce our product library.

More detailed restrictions may be included in our Commercial License Agreement.

17. Intellectual property

The Services and their content are owned by or licensed to Layer Supply and are protected by intellectual-property laws.

This includes, without limitation:

  • product files;
  • videos;
  • images;
  • previews;
  • graphics;
  • branding;
  • logos;
  • copy;
  • product names;
  • layouts;
  • website design;
  • source files;
  • downloadable resources;
  • audio;
  • software;
  • code.

You may not reproduce, copy, distribute, republish, scrape, modify, sell or exploit any part of the Services except where expressly permitted under an applicable product license.

“Layer Supply” and associated branding may not be used in a way that suggests partnership, sponsorship or endorsement without our prior written permission.

18. Updates to digital products

We may occasionally update a digital product to:

  • correct defects;
  • improve compatibility;
  • replace corrupted files;
  • improve organization;
  • update documentation;
  • make minor creative or technical improvements.

A purchase does not automatically include every future expansion, major version, sequel or newly released product unless this is expressly stated.

We do not guarantee indefinite compatibility with future versions of third-party software, operating systems or plugins. This does not affect any mandatory obligation to provide legally required updates or ensure conformity where applicable.

19. Refunds

Refunds and cancellation requests are handled under our Return and Refund Policy.

Because digital products can be copied and retained after delivery, purchases are generally final after download access has been provided, except where:

  • mandatory consumer law requires otherwise;
  • a product is materially defective;
  • the purchased files cannot be delivered;
  • the wrong product was supplied;
  • another refund ground described in our Return and Refund Policy applies.

When a refund is issued, the customer’s license to use the refunded product ends immediately.

The customer must then:

  • stop using the product;
  • delete all copies in their possession or control;
  • not use the product in future projects;
  • not share or redistribute the product.

A refund does not automatically require removal of a finished project lawfully created and published before the refund, unless the refund resulted from fraud, unauthorized use or a license violation.

20. Chargebacks and payment disputes

Please contact us at contact@layersupply.store before initiating a chargeback or payment dispute so we can investigate the issue.

We reserve the right to suspend download access and associated licenses when:

  • a payment is reversed;
  • a chargeback is initiated;
  • a payment is found to be unauthorized;
  • fraud or misuse is reasonably suspected.

An unjustified chargeback does not grant the customer a right to continue using the disputed products.

Nothing in this section prevents a customer from exercising legitimate rights through their bank, payment provider or applicable dispute-resolution procedure.

21. Third-party services and software

Our products may be designed for use with third-party software, platforms or plugins.

References to third-party products do not imply ownership, partnership or endorsement unless expressly stated.

You are responsible for obtaining any required third-party software or licenses.

We are not responsible for:

  • changes made by third-party software providers;
  • discontinued software;
  • third-party outages;
  • changes to third-party file support;
  • incompatibility introduced by unsupported software updates;
  • loss caused exclusively by third-party products outside our control.

This does not affect responsibility for compatibility or functionality that we expressly promised at the time of purchase.

22. Optional third-party tools

We may provide access to tools, integrations or services operated by third parties.

These tools may be governed by separate terms and privacy policies. We do not control third-party services and are not responsible for their independent acts or omissions.

Where permitted by law, your use of optional third-party tools is at your own discretion.

23. Third-party links

The Services may contain links to third-party websites.

We are not responsible for the content, accuracy, security, policies or practices of third-party websites. Visiting an external website is at your own discretion.

Complaints concerning third-party products or services should be directed to the relevant third party.

24. Shopify

Our store is powered by Shopify.

Purchases made through the Layer Supply store are agreements directly between you and Tillema Extended Media, trading under Arista Ecom. Shopify provides the e-commerce infrastructure but is not the seller of our products.

Shopify may process information and payments as necessary to operate the store. The processing of personal information is addressed in our Privacy Policy and, where applicable, Shopify’s own privacy documentation.

25. Privacy

We collect and process personal information in accordance with our Privacy Policy.

Because our Services are hosted through Shopify and may use other service providers, information may be processed by Shopify, payment providers, digital-delivery providers, analytics providers and other necessary service providers.

Please review our Privacy Policy for information about:

  • what data we collect;
  • why we process it;
  • how long we retain it;
  • with whom it may be shared;
  • international transfers;
  • cookies;
  • your rights under applicable privacy law.

26. Reviews, feedback and submitted content

When you voluntarily submit a review, testimonial, suggestion or other feedback, you confirm that:

  • you have the right to submit it;
  • it is truthful and not misleading;
  • it does not infringe third-party rights;
  • it does not contain unlawful, abusive or malicious content.

You grant us a non-exclusive, worldwide, royalty-free license to reproduce, publish and display that feedback for purposes connected with operating and promoting Layer Supply.

This license does not transfer ownership of your feedback to us.

We may moderate or remove feedback that is unlawful, fraudulent, irrelevant or violates these Terms.

Where reviews are incentivized or otherwise commercially connected, this should be disclosed as required by law.

27. Errors and inaccuracies

Occasionally, the Services may contain typographical errors, technical errors, incorrect product information or inaccurate pricing.

We may correct such errors and update the Services.

When an obvious pricing or technical error affects an order, we may contact you to offer:

  • fulfilment at the correct price;
  • cancellation of the order;
  • a refund where payment has already been collected.

We will not use this provision to unreasonably change a completed consumer agreement.

28. Prohibited use of the website

You may not use the Services to:

  • violate applicable law;
  • infringe intellectual-property rights;
  • distribute malware or harmful code;
  • gain unauthorized access to our systems;
  • interfere with website security;
  • scrape, extract or systematically copy our product catalogue;
  • impersonate another person or business;
  • submit fraudulent orders;
  • collect personal data from other users;
  • send spam or unsolicited communications;
  • circumvent access controls or download restrictions;
  • abuse discounts, accounts or payment systems;
  • assist others in violating these Terms.

We may take proportionate measures to protect the Services, including suspending access or cancelling fraudulent orders.

29. Availability of the Services

We aim to keep the Services available, but cannot guarantee uninterrupted or error-free access.

Temporary interruptions may occur due to:

  • maintenance;
  • updates;
  • hosting issues;
  • third-party outages;
  • cybersecurity incidents;
  • circumstances outside our reasonable control.

Where an interruption prevents delivery of a purchased product, we will take reasonable steps to restore access or provide an appropriate remedy.

30. Disclaimer

Creative examples, previews, tutorials and marketing materials are provided to demonstrate potential uses of our products.

We do not guarantee that purchasing or using a product will produce a specific creative, commercial or financial result.

Customers remain responsible for:

  • their creative decisions;
  • project execution;
  • software use;
  • compliance with laws and third-party rights;
  • backing up their own project files;
  • reviewing finished work before publication or delivery.

Nothing in these Terms excludes warranties or remedies that cannot legally be excluded.

31. Limitation of liability

To the extent permitted by law, Layer Supply is not liable for indirect or consequential losses such as:

  • lost profit;
  • lost revenue;
  • lost opportunities;
  • loss of business;
  • loss caused by failure to maintain backups;
  • losses caused by unsupported third-party software;
  • damage arising from unauthorized modification or misuse of a product.

Where we are liable for direct damage, our liability will, to the extent permitted by law, be limited to the amount paid for the product or order giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited, including liability resulting from intent, deliberate recklessness or mandatory consumer law.

Nothing in these Terms limits a consumer’s statutory right to appropriate remedies for digital content that is not supplied or does not conform to the agreement.

Dutch consumer rules do not allow businesses to rely on unreasonably broad exclusions of liability in standard terms.

32. Responsibility for violations

You are responsible for losses and third-party claims resulting directly from:

  • your unlawful use of the Services;
  • your infringement of third-party rights;
  • your unauthorized redistribution of products;
  • your material breach of an applicable product license;
  • fraudulent conduct attributable to you.

This section does not create liability beyond what is permitted under applicable law.

33. Suspension and termination

We may suspend or terminate access to the Services where reasonably necessary because of:

  • fraud;
  • non-payment;
  • chargebacks;
  • account compromise;
  • unlawful conduct;
  • unauthorized distribution;
  • serious or repeated license violations;
  • material breach of these Terms.

Where appropriate, we may first provide notice and an opportunity to correct the violation.

Termination does not affect:

  • payment obligations already incurred;
  • rights and remedies that arose before termination;
  • intellectual-property provisions;
  • license restrictions;
  • provisions which by their nature should continue.

34. Complaints

Questions and complaints may be sent to:

Please include:

  • your name;
  • order number;
  • email address used for the order;
  • a clear description of the complaint;
  • relevant screenshots or supporting information.

We will review complaints within a reasonable period and aim to provide a substantive response within 14 days.

35. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

36. No waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

A waiver is valid only when expressly confirmed in writing.

37. Entire agreement

These Terms and the policies and agreements incorporated by reference form the agreement governing your use of the Services and purchase of our products.

Product-specific descriptions and license terms remain part of the relevant purchase agreement.

In the event of conflict, the following order of priority applies:

  1. mandatory applicable law;
  2. product-specific terms clearly presented before purchase;
  3. the Commercial License Agreement;
  4. these Terms of Service;
  5. general website information.

38. Assignment

You may not transfer your rights or obligations under these Terms without our prior written permission.

We may transfer our rights and obligations as part of a legitimate restructuring, sale or transfer of the business, provided this does not reduce mandatory consumer rights.

39. Governing law

These Terms and agreements entered into through the Services are governed by Dutch law.

If you are a consumer residing outside the Netherlands, this choice of law does not deprive you of mandatory consumer protections available under the law of your country of residence.

Disputes will be submitted to the competent court under applicable law. Nothing in these Terms requires a consumer to bring proceedings exclusively in the Netherlands where mandatory jurisdiction rules provide otherwise.

40. Changes to these Terms

We may update these Terms when reasonably necessary, including because of:

  • changes to our Services;
  • changes to our products or licensing model;
  • legal or regulatory developments;
  • security requirements;
  • changes to service providers.

The current version will be published on this page with a revised “Last updated” date.

Changes do not retroactively alter completed purchases unless required by law or expressly agreed.

Material changes affecting ongoing Services will be communicated where required.
